1. Acceptance of Terms & Eligibility
By creating an account or using NFL Big Pick'em (the "Service"), you agree to be bound by these Terms and Conditions ("Terms").
Age Requirements
- You must be at least 13 years old to use the Service — to create a player account, join a Room, or create a Room as a Commissioner.
- Users between 13 and 18 years of age may use the Service, including paying any applicable fees, only with the consent and supervision of a parent or legal guardian.
2. Description of the Service
NFL Big Pick'em is a platform that lets a group of friends (a "Room") run their own private NFL prediction game for a season. Every player, including the Commissioner, pays the same one-time $5 fee for their seat in a Room. Players make weekly predictions on NFL games and earn points based on a fixed, published scoring system.
What NFL Big Pick'em is:
- A software tool for organizing, scoring, and displaying results for a private prediction game among people you invite.
- The per-seat fee covers hosting and use of the platform's software only.
What NFL Big Pick'em is NOT:
- NFL Big Pick'em is not a sportsbook and does not accept bets or wagers.
- NFL Big Pick'em does not set odds or point spreads of any kind.
- NFL Big Pick'em does not collect, hold, or distribute any money between players.
- Any money a Room's members choose to put at stake, and how any winnings are split, is decided and handled entirely by the Commissioner and players themselves, privately, outside the Service. See Section 9 for more detail.
3. User Accounts & Security
One Account Per Person: Users are limited to one account per person. Creating multiple accounts to manipulate rankings, standings, or gameplay may result in suspension or permanent termination.
Username Policy: Usernames must not be offensive, defamatory, misleading, or infringe upon the rights of others.
Commissioner Responsibility: A Room's Commissioner is responsible for the accuracy of their Room's settings (entry fee amount, invited players, etc.) and for communicating those terms to their players directly — the Service only displays what the Commissioner enters.
4. Room Privacy & Visibility
Unlike public leaderboard products, NFL Big Pick'em Rooms are private. By joining a Room, you acknowledge that your username, picks, and results will be visible to other members of that specific Room only — not to the public or to members of any other Room.
5. Community Conduct
Users agree to use NFL Big Pick'em respectfully and lawfully. Prohibited behavior includes:
- Harassment, bullying, hate speech, or threats.
- Attempting to exploit, manipulate, or disrupt the Service (including its scoring, room caps, or account systems).
- Using the Service to facilitate any activity that is illegal in your jurisdiction.
- Misrepresenting the terms of a Room (fees, stakes, or payout arrangements) to other players.
6. Intellectual Property
All original content, site design, branding, and software associated with NFL Big Pick'em are the property of NFL Big Pick'em.
Third-Party Trademarks: NFL Big Pick'em may display Team names, Team logos, and League names. These trademarks are the property of their respective owners (e.g., the NFL) and are used solely for informational, descriptive, and entertainment purposes.
7. No Affiliation Disclaimer
NFL Big Pick'em is an independent, fan-created platform. We are NOT affiliated with, endorsed by, sponsored by, or associated with the National Football League (NFL), any NFL team, or any other professional sports league.
8. Limitation of Liability
The Service is provided "as-is" and "as available." NFL Big Pick'em relies on third-party data providers for game schedules, kickoff times, and scores; we do not guarantee that all data will be correct, complete, or up to date at all times.
To the maximum extent permitted by law, NFL Big Pick'em's total liability for any claim arising from your use of the Service shall not exceed the total fees you personally paid to NFL Big Pick'em in the twelve (12) months preceding the claim.
9. Player-to-Player Financial Arrangements
This section is important — please read it carefully.
NFL Big Pick'em does not collect, hold, transmit, or guarantee any money, prize, or payout between players. Any decision by a Room's members to put money at stake, and any agreement about how winnings are split, is made entirely by those individuals, privately, and entirely outside of and unconnected to the Service.
As a result:
- NFL Big Pick'em is not a party to, and bears no responsibility for, any private financial arrangement between players.
- NFL Big Pick'em cannot and does not guarantee that any player will honor a payment or payout arrangement made with other players.
- Any dispute about money owed between players must be resolved between those players directly — NFL Big Pick'em has no ability to mediate, refund, or enforce private arrangements it was never a party to.
- The Service's own per-seat fee is separate and distinct from any money players choose to put at stake with each other, and is non-refundable except as otherwise stated in these Terms.
10. Fees & Payments
- Every player who joins a Room, including the Commissioner, pays the same flat $5 one-time fee for their seat. This fee is not affected by room size.
- These fees cover one NFL season for that specific Room and do not renew automatically; running the game again in a future season requires creating a new Room and paying the applicable fees again.
- A player's seat fee is charged when they submit picks in a Room and is separate for each Room they join.
- All fees paid to NFL Big Pick'em are non-refundable, except in the following circumstances:
- (a) where required by applicable law;
- (b) a demonstrable billing error — meaning a duplicate charge, or a charge that does not match the $5 fee — verifiable against our payment processor's transaction records;
- (c) a Room is removed or terminated by NFL Big Pick'em before the player made any picks in that Room;
- (d) an extended Service outage — meaning the Service is unavailable for 48 or more consecutive hours during a period when picks needed to be submitted for that Room.
